Promotion Period: April 1, 2008 through August 30, 2008
1. Description of Contest/Participation. How to Play: There are two ways to enter to have a chance at participating in the car giveaway on the afternoon of August 30, 2008 in Myrtle Beach, SC. 1. Enter online at www.sunfunfestival.com/chancetowin/ between 12:00:01 a.m. EDT on April 18, 2008 and 5:00:00 pm. EDT on August 15, 2008. You must complete the entry form online with name, address, phone # that you can be reached by August 30, 2008, e-mail address and age. 2. Sign up by completing an entry form with name, address, phone, age and e-mail address at various on-site media partner’s booths during the promotion period or by listening to the various partner radio stations or reading participating partner newspapers, filling out the entry form and depositing it according to the various media partners directions. Internet entries must be received by 5:00 p.m. on August 15, 2008. All other local media event entries and the Sun Fun Festival entries deposited at the Chamber Location in Myrtle Beach must be deposited by 5:00 p.m. on August 30, 2008. Limit one entry per person regardless of entry method.
A random drawing will take place on or about August 15, 2008 at approx. 6:00 p.m. at the Myrtle Beach Chamber of Commerce to choose 5 finalists from the internet entries and 13 finalists from the various combined media event entries and local chamber entries deposited in person. Another random drawing will take place on August 15, 2008 to choose two finalists from among all other entries collected at various local media events and designated Chamber of Commerce entry boxes combined. Non winning entries from the August 15 drawings will be rolled over into the June 2 drawing. A total of twenty finalists will be selected and notified by the evening of August 25, 2008 inviting them to participate in the contest dig on August 30, 2008. If the finalists cannot be reached or confirmed, Sponsor reserves the right to contact an alternate to take their place provided sufficient time is available. Drawing and contest will be conducted by the Myrtle Beach Convention and Visitors Bureau, Myrtle Beach Chamber of Commerce and officials of the Sun Fun Festival.
Contest finalists will have the opportunity to compete for a chance to win a 2008 Ford Focus 4-door sedan car by participating in an event to uncover the winning keys hidden in a sand castle at the 2008 Sun Festival. There will be up to twenty finalists that will participate in the timed countdown race to uncover the winning set of keys that will start the 2008 Ford Focus. Entrants will be racing against each other to find a key that they will then attempt to unlock a box that will hold the key/transmitter to open the car. Each contestant will be required to carry only one set of keys at one time. They will attempt to unlock the box that holds the winning transmitter/key set that will unlock the car. If the key that the person finds and carries over to the locked box does not unlock the car, then they must go back and find another set. Each contestant is allowed to hold only one set of keys at a time. Any attempt to hide or otherwise deceive the other participants will result in immediate disqualification. Any attempt to hoard more than one set of keys will also result in disqualification. The contestants must continue looking for the keys and attempting to open the car until someone finally opens the box and uses the key/transmitter to open the car, thus winning the vehicle.
Contest is open to legal U.S. residents, excluding Florida and New York, age 18 or older as of April 18, 2008 who will be available and ready to participate at the Sun Fun Festival in Myrtle Beach South Carolina on August 30, 2008. Employees of the Myrtle Beach Chamber of Commerce, various media partners and sponsors of the Sun Fun Festival and any affiliates, retailers, advertising and promotion agencies and the immediate family or household members of each are not eligible.
2. Prize: Contest finalists will compete for the chance to win ONE (1) 2008 Ford Focus car. Approximate Retail Value of prize: $14,609.00. Only one prize will be awarded for the entire promotion. The car will be encased in advertising wrap for the first three months of the winner’s ownership. Owner will agree to drive the car with this advertising wrap until January 30, 2009 at which time the advertising messages will be removed by the Myrtle Beach Area Chamber of Commerce at no cost to the winner. Sponsor reserves the right to substitute prize of equal or greater value if the featured prize becomes unavailable. Winner will be responsible for all tax, title and license fees associated with the vehicle and must produce a valid driver’s license and proof of insurance in order to take delivery of the vehicle. All other expenses not specifically mentioned herein are the sole responsibility of the prize winner. All finalists must be available on August 30, 2008 from 11:00 a.m. to 2 p.m. or they will be disqualified and an alternate finalist may take their place. No cash equivalent for prize will be awarded. Prize is nontransferable. Grand Prize Winner is responsible for all title, license, registration, insurance and other fees associated with the vehicle. Grand Prize winner must present a valid drivers license and proof of insurance at time of delivery. Winner must take delivery of the vehicle by September 3, 2008. Winner is responsible for delivery/driving of vehicle to their home residence.
3. Eligibility and Limitations. Open to legal US residents at least 18 years old as determined by the Sponsor who reside in or will be vacationing/staying in or residing in the Myrtle Beach area on August 30, 2008. Only one (1) entry per person. Employees of Sponsor, participating sponsors, media partners, and their advertising agencies, and members of the immediate family of any such persons are not eligible to participate or win. The term "immediate family" includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as "in-laws," or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.
4. Internet. Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor or presenter on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the sweepstakes. In the event the online portion of the promotion is terminated for any reason, Sponsor reserves the right to award the prize from among all entries received prior to termination. CAUTION: ANY ATTEMPT BY A CONTESTANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GAME IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH CONTESTANT TO THE FULLEST EXTENT OF THE LAW.
In the event of a dispute as to any entry, the authorized account holder, i.e., natural person, of the email address used to enter will be deemed to be the entrant. Potential winners may be required to show proof of identification. Sponsor may require that a potential winner provide proof that he/she is the authorized account holder of the e-mail address and/or username associated with the winning entry.
5. Publicity: Use of Personal Information/Audio Recordings. By participating, all participants and winner(s) grant the Sponsor exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other Promotions and waive any claims to royalty, right, or remuneration for such use. By participating in the Promotion, participants agree that the Sponsor may disclose personal information obtained from participants in the Promotion to third parties and use such information for marketing and other purposes.
6. Release. By participating in the Promotion, each participant and winner waives any and all claims of liability against Sponsor, participating radio stations, newspapers and other media partners, their employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Promotion, or from the use of any prize. In order to participate in the Sand Castle Contest for the winning key, finalists must sign an Affidavit of Eligibility and Liability/Publicity Release by 10 a.m. on August 30, 2008. Finalists must be physically able to dig for the keys and run to and from the locked box that holds the winning transmitter and key.
7. Taxes. Any valuation of the prize stated above is based on available information provided to the Sponsor, and the value of any prize awarded to a winner will be reported for tax purposes as required by law. Winner is solely responsible for reporting and paying any and all applicable taxes. Each winner must provide the Sponsor with valid identification and a valid taxpayer identification number or social security number before the prize will be awarded. Prize is not transferable, redeemable for cash or exchangeable for any other prize.
8. Conduct and Decisions. By participating in the Promotion, participants agree to be bound by these Official Rules and agree that the judges’ decisions are final in all matters relating to the contest. Persons who violate any rule, gain unfair advantage in participating in the Promotion, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Sponsor will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Promotion and the Sponsor’s decisions concerning such disputes shall be final. If the conduct or outcome of the Promotion is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Sponsor, the Sponsor reserves the right to terminate this Promotion, or make such other decisions regarding the outcome as the Sponsor deems appropriate. All decisions will be made by the Sponsor and are final. The Sponsor may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS PROMOTION, TELEPHONE SYSTEMS OR WEBSITE, OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPATE TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Miscellaneous. The winner must submit proof of eligibility and sign the Sponsor’s release form to claim the prize. No purchase necessary to participate or win. Void in FL and NY and where prohibited. The Sponsor disclaims any responsibility to notify participants of any aspect related to the conduct of the Promotion. Written copies of these rules are available during normal business hours at the business office of the Myrtle Beach Chamber of Commerce and by mail upon written request with a stamped, self-addressed return envelope (see station address). All entries become the property of the Sponsor and will not be returned.
10. Compliance with Law. The conduct of the Promotion is governed by the applicable laws of the Unites States of America, which take precedence over any rule to the contrary herein. Sponsor shall follow the applicable laws for conducting Promotions, including notice to the state attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, running specific on-air disclaimers, providing specific written information about the Promotion, etc. as required by local and state law.
